Terms of Service

Welcome to Data Blokes (“Platform”). By accessing or using the Platform, you agree to be bound by these Terms and Conditions (“Terms”), forming a legally binding agreement between you and Data Blokes. If you do not agree with these Terms, please do not use the Platform.


1. Account Registration

To fully access the Platform and its features, you may need to create an account. You agree to provide accurate and complete information during registration. You are responsible for maintaining the confidentiality of your account credentials and all activities under your account.


2. Professional Profiles

  • For Candidates: By creating a professional profile, you agree to provide accurate, truthful, and up-to-date information, including your qualifications, skills, work history, and contact details. You acknowledge that the visibility of your profile to employers is subject to your chosen privacy settings.
  • For Employers: Access to candidate profiles may require payment of fees. You agree not to misuse candidate information obtained through the Platform and must comply with all applicable Australian privacy and employment laws.

3. Job Applications / Introductions

Unlike traditional job boards, our Platform enables employers to request introductions with candidates. We do not guarantee that introductions will lead to employment outcomes. All hiring decisions remain solely the responsibility of employers and candidates.


4. User Content

The Platform may allow you to upload or submit content, including resumes, profiles, job descriptions, or messages (“User Content”). You retain ownership of your User Content, but by providing it to us, you grant Data Blokes a non-exclusive, royalty-free, transferable licence to use, reproduce, distribute, and display your User Content solely in connection with operating and promoting the Platform.


5. Prohibited Activities

You agree not to:

  • Post or provide false, misleading, or fraudulent information.
  • Harass, intimidate, or threaten other Users or Platform staff.
  • Attempt to gain unauthorised access to the Platform or other accounts.
  • Use automated means (bots, scrapers, spiders) to collect User data.
  • Circumvent Platform fees by contacting Users outside the Platform (see “Anti-Leakage” obligations in our business rules).
  • Breach any applicable laws, including the Fair Work Act 2009 (Cth)Privacy Act 1988 (Cth), and other employment-related legislation.

6. Privacy

Your privacy is important to us. Please review our Privacy Policy for details on how we collect, use, and disclose your information in accordance with the Privacy Act 1988 (Cth) and the Australian Privacy Principles (APPs).


7. Fees and Payments

Employers may be required to pay fees to access candidate profiles, request introductions, or use other premium features. All payments are processed securely through third-party providers (e.g. Stripe, PayPal). Fees are non-refundable except as required under the Australian Consumer Law (ACL).


8. Modifications to the Platform

We reserve the right to modify, suspend, or discontinue any part of the Platform at any time without notice. We may also impose limits on certain features or restrict access without liability.


9. Indemnification

You agree to indemnify and hold Data Blokes, its officers, employees, and contractors harmless from any claims, damages, or liabilities arising from your use of the Platform, your User Content, or your breach of these Terms.


10. Limitation of Liability

To the maximum extent permitted by law, Data Blokes will not be liable for indirect, incidental, or consequential damages, including loss of profits, arising from use of the Platform.

Nothing in these Terms limits your rights under the Australian Consumer Law (ACL). If the ACL applies, our liability is limited (where lawful) to the resupply of services or refund of fees paid.


11. Governing Law and Jurisdiction

These Terms are governed by the laws of New South Wales, Australia (or your state of incorporation). Any disputes shall be subject to the exclusive jurisdiction of the courts of that state and the Commonwealth of Australia.


12. Changes to the Terms

We may update these Terms from time to time. Any changes will be posted on this page, and the “Effective Date” will reflect the latest revision. Continued use of the Platform after updates constitutes acceptance of the new Terms.
